Licensed Default Attorney / Associate Attorney
We are seeking a Licensed Default Attorney to oversee all aspects of mortgage and lending client case portfolios from assignment to conclusion for a mid-sized firm located in Mount Laurel, NJ. In the role, the attorney will research and analyze statutes, judicial decisions and legal articles, draft legal pleadings, notices of hearings, motions, and orders. This position is open to Associate-level Attorneys looking to gain experience in the mortgage industry.
Foreclosure Proceedings : When a borrower fails to make mortgage payments, a default attorney represents lenders or mortgage servicers in foreclosure actions. This involves preparing and filing necessary legal documents, representing clients in court, and managing the legal process to recover the owed amount or facilitate the sale of the property.
Debt Collection : Default attorneys may also handle cases where creditors seek to collect outstanding debts. This can involve filing lawsuits against debtors, negotiating settlements, and ensuring that collection actions comply with relevant laws and regulations.
Legal Documentation : These attorneys prepare and review legal documents related to defaults, such as notices of default, summonses, complaints, and motions.
Court Representation : They represent their clients in court hearings and trials, presenting evidence and arguments to support the client’s case.
Compliance : Default attorneys ensure that all legal proceedings comply with state and federal laws, including consumer protection laws and foreclosure regulations.
Negotiation and Settlement : They may work on negotiating repayment plans or settlements between parties to resolve default issues outside of court.
